Online Consent Form and Service Level Agreement - Member Hardware / Software Technical Assistance
By logging into this website and requesting service, I hereby authorize and request Santa Clara County Association of Realtors® (“SCCAOR”) Desktop Support Technician to perform certain services to my computer online, including my computer's existing software and network systems (if necessary or requested). I am requesting these services from SCCAOR because my computer will not function correctly in order for me to use my computer for my real estate business. I certify that my computer is used primarily used for work in relation to my business as a licensed real estate agent or broker and that I am a member in good standing of SCCAOR. I am requesting SCCAOR's assistance in the installation and/or in troubleshooting of the related software or hardware on my computer so that I can better use my computer in my business.
By logging onto this website and requesting service from SCCAOR, I agree to the terms of this consent form. I understand that SCCAOR makes no guaranty or warranty of any kind whatsoever with regard to the success of its endeavors with regard to the services to be rendered to my computer, its software, or network and that SCCAOR will make reasonable efforts to help me.
I also understand that I should remove any confidential or proprietary information from my computer before SCCAOR begins its work if I am concerned that someone else will have access to this information while working on my computer. I understand that SCCAOR will make every effort to troubleshoot the problems with my computer online. However, in the event SCCAOR is unable to remedy the problems on line, I understand that I may have to bring my computer into SCCAOR for work and that if I am concerned about confidential or proprietary information on my computer, I will remove that information before I bring my computer into SCCAOR. In the event I bring my computer into SCCAOR for work, I understand that SCCAOR cannot guaranty the amount of time it will take to diagnose the problems with my computer and cannot therefore, guaranty a definite return date. Upon delivery to SCCAOR, SCCAOR will attempt to estimate the number of days required to perform its services.
In the event I bring my computer into SCCAOR for work, I agree and authorize SCCAOR to spend no more than $100 on repairs and upgrades unless I give authorization to spend more.
I fully understand and agree to the following statements thereby fully and unconditionally releasing SCCAOR and its officers, directors, members and employees of any and all liability which may result from the services performed on my computer's hardware, software or network.
Unconditional Release and Waiver
1) I fully and unconditionally release SCCAOR, and its officers, directors, members and employees from any and all liability caused by any SCCAOR employee while performing services on my computer or network. This release covers hardware, software or operating system issues and any other issue which may arise.
2) I fully and unconditionally release SCCAOR, and its officers, directors, members and employees from any and all liability caused to any data that is saved on my computer or network. I understand that SCCAOR is unable to determine what data is important and therefore SCCAOR, its officers, directors, members and employees shall not be held liable for the loss of any or all of my data.
3) I understand and accept any attempt made by SCCAOR employees to determine what problems exist with my computer. I authorized SCCAOR employees to remove, re-configure or install any necessary hardware, software or operating system settings. I fully understand that this my cause significant changes to my computer's performance which may never be recoverable.
4) In no event shall SCCAOR, its officers, directors, members and employees be liable for any damages, whether in contract or tort (including, but not limited to negligence), including but not limited to direct, consequential, special, exemplary, incidental and indirect damages, lost profits, lost sales or business expenditures, investments, or commitments in connection with any business, loss of any goodwill, or loss of any data arising out of or in connection with the services to be rendered hereunder.
5) It is agreed and understood that the services to be rendered under this Consent Form are being provided by SCCOAR to its members on a voluntary basis and at no charge to me. I will however, pay the costs of any software or hardware upgrades, changes or modifications which SCCOAR is required to install to in order for my computer to function correctly, provided I am informed of those costs and pay those costs in advance of any purchase by SCCOAR.
Knowing and Voluntary Execution
I hereby authorize SCCAOR to work on my computer based on the above terms.
I have carefully read this Consent Form and Service Level Agreement – Member Hardware/Software Assistance, and fully understand its contents. I am aware that SCCOAR shall have no liability whatsoever with regard to the services rendered to me under this Consent Form and sign it of my own free will.

To allow SCCAOR to Remotely Administer your computer, you must state your agreement to the above terms and conditions by clicking on the agree button which will allow you to permit SCCAOR to access your computer.
